Terms & Conditions
These terms and conditions pertain to all website users and customers of any FISHER WEISMAN COLLECTION (FWC) products. FISHER WEISMAN COLLECTION manufactures furniture, lighting and accessories. No employee or other representative of FWC has any authority to waive these policies and only the Chief Executive Officer, President or Operations Manager has authority to waive any provision of these Terms and Conditions. Any waiver must be in writing signed by the FWC authorized representative. This requirement for signed and written consent is not waivable.
Acceptance – The terms and conditions set forth herein represent a Fisher Weisman Collection offer to sell product to the purchaser. The purchaser’s acceptance of a Fisher Weisman Collection sales order acknowledgement or invoice is an acceptance of these terms and conditions. In the event that the terms and conditions of an order are contrary to the terms and conditions indicated herein, these terms and conditions shall supersede any inconsistent or contrary terms and conditions indicated on the actual order or any other document supplied by the purchaser. A waiver of any one term or condition shall not be deemed a waiver of any other term or condition.
Claims – All claims for workmanship defects, shortages and errors must be made within 2 days of the receipt of the merchandise to “customerservice@fisherweisman.com.” Any repairs or claims must be documented in writing
accompanied by photographs and sent to Fisher Weisman Collection customer service. Payments will not be made for unauthorized repairs. Failure to make a claim within this period of time constitutes acceptance of the merchandise and a waiver of claims. All merchandise is inspected before shipping. All merchandise is signed for by the freight company, stating that the items have been picked up in good condition. Third party shippers have sole responsibility for any damage, loss or shortages incurred during transit. Purchasers or their receiving warehouses must inspect the items upon arrival and make claims for any damage, loss or shortages directly to the carrier. Fisher Weisman Collection is not responsible for any freight-related claims, but will assist the purchaser in this process. No merchandise can be returned to Fisher Weisman Collection without its written consent. Unauthorized returns will be returned freight collect to the location of origin. Claims resulting in lawsuits must be filed with the court of competent jurisdiction in the state of California.
Custom – Custom quotes must be reviewed by Fisher Weisman Collection for suitability before being accepted into production. Fisher Weisman Collection reserves the right to reject custom requests.
Delivery – Delivery dates and lead times are estimates only, based on current production schedules at the time of the order and are subject to change. Production cannot begin and lead times cannot be calculated until the acceptance of the order. Acceptance of the order includes: receipt of the required deposit, receipt of all specifications and confirmation of any changes, modifications or approvals to the original order. Fisher Weisman Collection shall not be held responsible for any delays in production. Fisher Weisman Collection shall not be liable for any costs related to late deliveries. All freight is FOB Laredo, TX, Los Angeles or San Francisco, CA.
Orders – Written orders received from the purchaser with complete information will be acknowledged by Fisher Weisman Collection in writing within 48 hours. Fisher Weisman Collection reserves the right to reject any order, refund any deposit and return any materials freight collect. It is the responsibility of the purchaser to advise Fisher Weisman Collection in writing of any errors or discrepancies in the sales order acknowledgement within 5 days of the receipt of said acknowledgement. Changes to an order are subject to additional charges, for materials, labor and other related costs and the order will be held until written confirmation of any additional changes are received from the purchaser. All furniture is subject to minor changes in details from the specifications noted as it applies to hardware, finishes and other minor details.
Payment – Fisher Weisman Collection requires a deposit of 50% of the total purchase price for all orders. Orders received without a deposit will be held from production pending receipt of deposit. Final payment is due 10 days before shipping unless Fisher Weisman Collection agrees in writing to any other payment terms. All payments must be received from the purchaser as identified on the purchase order, as no third party payments will be accepted unless approved in writing by Fisher Weisman Collection. Acceptance of third party payments is an accommodation and does not create any relationship between Fisher Weisman Collection and the third party. A service charge of 1.5% per month will be applied to orders that remain unpaid after 60 days of being invoiced. Canceled orders are subject to a cancellation fee. Acknowledged orders canceled prior to entering production are subject to a charge in the amount of 20% of the total item. Orders canceled thereafter will be subject to a larger cancellation fee set at the sole discretion of Fisher Weisman Collection. The purchaser agrees that the cancellation fees correlate to the reasonable estimate of Fisher Weisman Collection actual losses on the canceled order. Any order not shipped within 30 days of notification of completion may be subject to a storage charge of $50 a month.
Prices – All Fisher Weisman Collection prices indicated in the current schedule are net to-the-trade prices. Prices are subject to change without notice. Fisher Weisman Collection reserves the right to change prices, after an order has been received, based on changes in quantities or total value of previously quoted contract quotations, changed orders from the purchaser and to correct pricing on orders received with modifications from the original order. Prices do not include cartoning and packing, freight or delivery, in-transit insurance, storage, service, taxes, receiving or installation. All prices are FOB Laredo, TX, Los Angeles or San Francisco, CA unless acknowledged otherwise.
Products – Fisher Weisman Collection reserves the right to make minor changes in furniture design, dimensions and other materials without prior notice. Because each Fisher Weisman Collection piece is hand-assembled and hand-finished, including placement of individual papier mâché pieces, we are unable to control size and location of natural organic materials markings, nor can we match from piece to piece. All dimensions have slight variations. Finishes can vary from samples and exact matching is not guaranteed. For the protection of personal property and personal safety, we strongly recommend the use of a steel cable to support the weight of chandeliers. All chandelier heights denote fixture height, and do not include the standard 3’ included in the standard height. Additional chain may be purchased in 1’ increments.
Warranty – Fisher Weisman Collection products are sold with a limited warranty against defects in materials and workmanship for a period of six months from the delivery date. Fisher Weisman Collection chandeliers and sconces are UL certified and marked as such. Fisher Weisman Collection reserves the right to repair or replace defective merchandise at its sole discretion. This limited warranty applies only to products and materials manufactured and supplied by Fisher Weisman Collection. Damage caused by shipping, accident, abuse, misuse, cleaning, or normal wear and tear are not covered under this Warranty. All other warranties express or implied are excluded.
